NDPC, EUROJUST and EUROPOL Align on Criminal Investigation Data Protection

The Nigeria Data Protection Commission (NDPC) is working to align data protection safeguards with European Union agencies to manage the exchange of personal data during transnational criminal investigations.

During a recent meeting in Abuja, the National Commissioner of the NDPC, Dr Vincent Olatunji, received José de la Mata Amaya, the Vice President of the European Union Agency for Criminal Justice Cooperation (EUROJUST). The delegation included representatives from the European Union Agency for Law Enforcement Cooperation (EUROPOL).

Regulating Data Exchange in Law Enforcement

The discussions focused on an ongoing project led by EUROJUST and EUROPOL designed to improve information exchange, evidence sharing, and coordinated operations in criminal investigations. A central component of this project involves the sharing of personal data between national security agencies, law enforcement bodies, and private service providers.

The EU delegation noted that the Nigeria Data Protection Act (NDP Act) 2023 provides a robust framework for these activities. They expressed interest in exploring how the NDPC manages the intersection of law enforcement needs and individual privacy rights.

Safeguarding Sensitive Security Data

Dr Olatunji emphasised that the processing of personal data by security and law enforcement agencies is highly sensitive and requires specific legal safeguards. He stated that the NDPC currently provides guidance to various Nigerian security agencies on the lawful processing and protection of personal data.

Beyond advisory roles, the Commission supports the judiciary and law enforcement agencies in investigations involving data protection violations and through various capacity-building initiatives.

The meeting concluded with a technical session between officials from the NDPC, EUROJUST, and EUROPOL to define specific areas of regulatory collaboration and information-sharing protocols.
