A reference check can reveal a job search before an offer

A reference check can reveal a job search before an offer is final. Applicants and recruiters should agree which referees may be contacted, when contact is expected and what information is relevant to the role.

The issue is a practical privacy handover. A name and telephone number supplied for a reference can connect a prospective employer to somebody in the applicant’s current workplace. Timing and scope deserve attention before that contact is made.

Agree the contact plan early

An applicant can ask whether references are taken before or after a particular hiring stage and whether the current employer will be contacted. If a referee is proposed for a different purpose, clarify that purpose rather than assuming the original permission covers every later conversation.

A recruiter should explain the organisation’s process and record material limits or agreed timing. This is a recommended workflow; the legal basis and requirements depend on the jurisdiction and circumstances. Consent should not be presented as the automatic answer to every employment-data question.

Ask for role-relevant information

Define what the organisation needs to establish. A reference request should not become an open invitation to share unrelated personal, health or family information.

The UK ICO’s employment-records guidance discusses references and the option of a limited factual reference. It is a UK reference point, not a statement that identical rules or access exemptions apply in Nigeria.

For a Nigerian organisation, assess the applicable data-protection and employment requirements with the relevant adviser. Keep the operational record specific enough that the review can address what is actually proposed.

Verify the recipient and the referee

Use established contact information and an appropriate verification process. A reference request arriving by email should not automatically receive an employee’s record simply because it names a real company.

Likewise, a recruiter should know which person is authorised to provide a reference and in what capacity. A personal comment from a former colleague is different from an official statement issued by an employer.

Keep a small decision record

Item What to record
Purpose The role-related question the reference supports
Timing The agreed hiring stage or contact date
Referee Identity, contact source and relevant capacity
Scope Information requested and limits communicated
Access Who reviews the response
Retention The applicable rule and responsible owner

Keep the response in the approved recruitment record, not a broad staff chat. If a summary is prepared, distinguish what the referee said from the recruiter’s assessment. Do not convert an ambiguous remark into a verified fact.

Handle corrections and requests through the right route

An applicant may question a detail or ask how information is being handled. Route the request to the responsible person and assess the applicable rights and exceptions. Avoid promising that every confidential reference can always be disclosed, or that no reference information can ever be accessed.

The privacy-request handover process helps a small team record the question, owner and deadline without circulating the underlying employment material unnecessarily.

Review what happens after recruitment

Identify which information is needed for the resulting employment relationship and what remains a recruitment record. Apply the appropriate retention and access arrangements to each category.

The ICO’s record-keeping guidance distinguishes different purposes and retention needs. A business should make that assessment under its own applicable requirements rather than carrying every recruitment file into a permanent staff folder.

A useful improvement for a small employer

Add reference requests to the privacy operations review. Give the process an owner, define the contact stage, limit the information requested and test the recipient-verification step with a fictional example. A clear process protects the applicant’s information and gives the employer a more reliable decision record.
